Eligible claims under Measure 49

  • New claims may be filed against the City for land use regulations passed after January 1, 2007, which "restrict" the residential use and reduce the fair market value of the properties. Industrial, commercial and billboard claims are no longer eligible.
  • Measure 49 claims must be filed within five years of passage of the challenged land use regulation.
  • Claimants must submit an appraisal meeting the requirements of Measure 49 proving that the regulation reduced the fair market value of the property. The appraisal must address value one year before and one year after enactment of the land use regulation.

Unincorporated Multnomah County claims
